2. Description of Service#

I, Ayhan Sipahi, provide software consultancy services. Our services include but are not limited to:

• Custom software development
• Technical consulting and architecture guidance
• Educational content and resources

3. User Accounts#

Registration#

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account

Account Responsibilities#

• You are responsible for all activities that occur under your account
• You must not share your account with others
• You must use the service in compliance with all applicable laws

4. Acceptable Use#

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Upload or transmit malicious code or content
• Violate any intellectual property rights

• All content and materials provided by me remain my intellectual property
• You retain ownership of content you create using our services
• You grant me a license to use your content as necessary to provide my services
• You may not reproduce, distribute, or create derivative works from my proprietary content without permission

6. Payment Terms#

Consultancy Services#

• All fees are non-refundable unless otherwise specified
• We reserve the right to change pricing with 30 days notice

Consulting Services#

• Consulting fees are agreed upon in separate contracts
• Payment terms will be specified in individual service agreements

7. Privacy and Data Protection#

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

8. Service Availability#

• We strive to maintain high service availability but cannot guarantee 100% uptime
• Scheduled maintenance will be announced in advance when possible
• We are not liable for service interruptions beyond our control

9. Limitation of Liability#

To the maximum extent permitted by law:

• I shall not be liable for any indirect, incidental, special, or consequential damages
• My total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim
• I provide services "as is" without warranties of any kind

10. Indemnification#

You agree to indemnify and hold me harmless from any claims, damages, or expenses arising from your use of my services or violation of these terms.

11. Termination#

• Either party may terminate the agreement with appropriate notice
• We may suspend or terminate your access immediately for violations of these terms
• Upon termination, you must cease using our services and may lose access to your data

12. Changes to Terms#

We reserve the right to modify these terms at any time. Material changes will be communicated via:

• Email notification to registered users
• Notice on our website
• In-app notifications for SaaS users

Continued use of our services after changes constitutes acceptance of the new terms.

13. Governing Law#

These terms are governed by German law. Any disputes shall be resolved in the courts of Berlin, Germany.
